Section 170 Road Traffic Act duties after a collision
Section 170 of the Road Traffic Act 1988 sets out what a driver must do after being involved in an accident where damage or injury occurs. You must stop, give your name and address (and vehicle owner's name and address if different) to any person with reasonable grounds to request it, and report the accident to a police station within 24 hours if you did not exchange details at the scene.
Failure to stop is a criminal offence carrying up to six months' imprisonment and a discretionary disqualification. Failure to report within 24 hours is a separate offence. Both offences apply regardless of fault, even if the collision was entirely the other driver's fault, you must comply with section 170.
Preserving evidence at the scene: take photos of all vehicles involved, the road markings, the traffic signs, the point of impact, and any tyre marks. Get the names and contact details of independent witnesses. Record the other driver's insurance details, registration number and V5C confirmation (take a photo of their insurance certificate if they will show it).
